These Terms & Conditions govern your use of the TrueFace application and related services (the “Service”) provided by Gustavo Alejandro Romero Ore (“TrueFace”, “we”, “us”). By creating an account or using the Service you agree to these Terms.

1. The Seller

The Service is provided by Gustavo Alejandro Romero Ore, trading as TrueFace. Any contract for the Service is between you and Gustavo Alejandro Romero Ore.

2. Acceptance

By creating an account, ticking the “I agree to the Terms & Privacy” checkbox, or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Notice. You must be of legal age in your jurisdiction. If you accept on behalf of an organisation, you confirm you have authority to bind it.

3. The Service

TrueFace is an AI forensic tool that analyses portrait images to detect filters, retouching, AI generation and deepfakes, and offers a reconstruction feature on premium plans. Results are probabilistic and provided “as is” — see Section 10.

4. Acceptable Use

You must not:

Use the Service unlawfully, fraudulently, or to harass, defame or harm others.
Upload content you do not have the right to process.
Infringe intellectual property, privacy or publicity rights.
Use outputs to create or distribute non-consensual intimate imagery, hate speech, harassment material, illegal deepfakes or other unlawful synthetic media.
Interfere with the security or integrity of the Service (malware, probing, scraping, reverse engineering, bypassing rate limits).
Resell, sublicense or redistribute the Service without our written consent.

You are solely responsible for your prompts, uploads, and how you use the outputs, including verifying their accuracy and lawfulness in your context.

5. Accounts

You must provide accurate information, keep it up to date, and safeguard your credentials. You are responsible for all activity under your account.

6. Payments — Stripe as Merchant of Record

Our order process is conducted by our online reseller Stripe.com. Stripe.com is the Merchant of Record for all our orders. Stripe provides all customer service inquiries and handles returns.

Payment, billing, currency conversion, taxes, invoicing, cancellations and refund mechanics are governed by the Stripe Buyer Terms in addition to these Terms. Subscriptions renew automatically at the interval shown at checkout until cancelled. You may cancel at any time from your account or via billing.stripe.com.

Refunds are governed by our Refund Policy.

7. Intellectual Property

All rights in the Service, including software, models, branding and documentation, are and remain the property of TrueFace and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose under your plan.

You retain rights in the images you upload. By uploading you grant us a limited licence to process them solely to provide the Service. If you opt in to research contributions, you additionally grant us a licence to use anonymised data to improve our models.

8. AI Outputs and Generative Content

Outputs are AI-generated estimations. Reconstructed “original face” imagery is an interpretation, not a literal photograph. Outputs may be inaccurate and are not suitable as the sole basis for regulated professional advice (legal, medical, financial) or for safety-critical decisions.

If you believe content on the Service infringes your rights, contact us via the in-app chat with topic “Copyright / takedown” and we will review promptly. We may suspend accounts that repeatedly infringe.

9. Service Level

We do not guarantee that the Service will be uninterrupted, timely, secure or error-free. We may modify, suspend or discontinue features at any time.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied or statutory (including merchantability, fitness for a particular purpose and non-infringement).

11. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability arising out of or in connection with the Service is capped at the fees you paid for the Service in the twelve (12) months preceding the event giving rise to the claim. We exclude liability for indirect, incidental, special, consequential or punitive damages, or loss of profits, revenue, data or goodwill. Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law.

12. Indemnity

You agree to indemnify and hold harmless TrueFace and Gustavo Alejandro Romero Ore from third-party claims arising out of your uploads, your unlawful use of the Service or your breach of these Terms.

13. Suspension and Termination

We may suspend or terminate your access (in whole or in part) for:

Material breach of these Terms;
Non-payment;
Security, fraud or abuse risk;
Repeated or serious policy violations; or
Where required by law.

You may close your account at any time. On termination, your right to use the Service ends and your data will be deleted or anonymised in accordance with the Privacy Notice (subject to legal retention requirements).

14. Changes to the Terms

We may update these Terms. Material changes will be communicated in-app or by email. Continued use after the effective date constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the jurisdiction of the seller’s habitual residence, without regard to conflict-of-law rules. Mandatory consumer protections of your country of residence still apply.

16. Assignment and Force Majeure

You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond reasonable control.
